I just recently formed a one job partnership which looks like it might continue. When we bid this job we got quotes for the plumbing from both our regular subs and we went with my partners. My partner has worked with him for quite some time and he was confident in his ability to get the job done for us. In the meantime I decided to use this new plumber on a small project of my own that would be completed before the partnership project. Although he is a very competent plumber I had a lot of trouble getting him to finish the job. Finally after many excuses he finished and when I expressed concern about the upcoming project and his ability to perform. He assured both myself and my partner that there would be “no problem”.
Well he lied! We are about 80% complete and he is significantly lagging behind us and this has been after countless unreturned phone calls, countless promises to show up and then not.
Early on in the project the customer decided to replace their hot water heater and since we knew that we would be in competion with the owners oil company we decided to let the plumber deal directly with the owner in order to keep the price down. They gave him a check for 75% and the water heater arrived within a few days however it has still not been installed. It’s been almost two months!
The customer has been out of the country for the majority of the project; coming in every 4 – 5 weeks and when he came in yesterday he nearly blew his top when he saw how behind the plumber was and that the hot water heater was still not installed. We are getting very close to completion and based on prior performance we are really afraid that the plumber is going to delay us.
We need to hit our completion date as closely as possible because the owners need to coordinate international travel plans with their movers. (The house has been emptied for the project)
My partner is very upset having vouched for the plumber and I’m sure he had no idea that this could happen.
What do you do with a sub that doesn’t show up when he says he will.
I am seriously considering kicking him off the job and hiring my plumber by the hour to finish the job. But I’ve never run into this before and don’t know what legal problems I could be setting us up for.
Our agreement with the plumber is verbal which isn’t the smartest thing to do. But may actually be in our favor now.
