I hired a contractor for an addition. He dug a 10′ hole for my basement and left for the weekend. We then received 5″ of rain in ten hours and, because of runoff, I now owned a four foot deep swimming pool that was seeping water into my existing finished basement. Thankfully I was home at the time this was happening and went to Home Depot at 10:00 PM.. and purchased a sum pump. Who is responsible for something like this? My builder (who was highly recommended, even by the building inspector) or me as the home owner who should protect his property from an act of God?
