Seems … the owners logic is …
“If” the customers willingly pay $500 to him for some of the additional work …
that he see’s no problem paying my total of $860.00

I asked exactly how his customers paying him affect me getting paid on work already agreed upon and completed. He didn’t have a really good answer.
Told him whatever … but I’m getting paid by him reguardless of his customers ideas on payments to him. Said … either way … your decision or the magistrates …
I’m getting paid $860.00 … so just let me know how we’re gonna do this.
So … I drive home … and call the PE. same beam.
I’d just received a second “second invoice” from him in the mail for $140.00
Same customers had agreed to go directly thru the PE as far as payments went. They paid the first draft … $350.00 … Guess they just decided they didn’t feel like paying the invoice for the revisions at $140.00.
what the hell is wrong with people?
Told the PE … Sorry. He knew they were to pay. I said I’ll call and “remind” them …
and if they don’t pay … I’ll pay him … then bill them the $140 plus percentages …
and send them a letter to notify I’m filing suit if they don’t pay.
So … the PE starts asking questions about going to the magistrates.
Seems he, for the first time, is taking someone in front of the magistrate the first week of December.
we had a nice little talk … I shoulda charged him $140 for legal advice …
Must be the season … everyone’s going to court!

Stupidity happened here too. Renter didn't want to pay up and expected me to eat it from what I gather because when they finally called they had no plan of working it out. Said they couldn't pay it which means they are broke?
My problem probably originated when I served them a 10 day eviction notice and they went bonkers. I blind sided them they said. Well hello? When they get that they move immediately , but not every thing . They are gone but half the stuff still resides there with the power on in their name. I guess they think they have 10 full days to move it .
Tonight I'm working there and rent it but cant start the rent date till I get the old renters moved out complete . Mean while I need to paint it and do the floors. Cant do it unless I do illegal and move their stuff . Ive got a letter that says they have moved and the law says the stuff is mine to recover damages . hmm. I don't want their stuff , but now they are keeping new renters out at my expense. Damn them.
Ive got a 1050 dollar check to deposit but cant start the rent till I get er done . Crazy! I also blew my trip over this mess that I had been planning in Ms.
Meanwhile Ive got another one to rent to that's going to be empty this weekend.
The court thing scared them to do something but didn't finish it .

As a kid me and a friend shoveled snow for a nominal fee. One woman paid my partner a dollar or two when the going rate was 4 or 5 and my buddy shoveled quite a bit of the snow back into the driveway.
Classic gambit.
Seen it a few times:
Someone sends you a bill, one you had agreed to pay, for $1000. You send him $500. If he misses the difference, some sloppy operators won't in a timely manner, your ahead $500.
If he complains drag your feet and vacillate for as long as possible. When he gets serious, throbbing veins and a bulge in his coat that looks a lot like a .357, you cut him a check for $250. And write on the check 'final payment for services rendered'.
When his secretary alerts him to the shortage and he calls tell him he agreed that that was the final payment and he had agreed. Accuse him of welshing on a deal when he disagrees. When he shows up with steam coming from his ears call the cops and have them drag him off your front porch. Next day get a restraining order.
When his secretary gets serious, is that a .357 or are you just happy to see me, you say he has taken enough of your time. Worse comes to worse you cut a check for $125.
You get the idea. It is a contest of wills. Remember that nothing is set in stone in business. Everything is negotiable until the cash is in hand. Sure you can write a bill for $1000 but if you agree to take $750 you get paid now and you won't need to give yourself a coronary to get the $750 your going to get anyway a piece at a time.
And any time you want to sue me bring it on. I own nothing. No business is done in my name. Stack settlement up to the sky and you have some very expensive toilet paper.
As one guy told me, I paraphrase: 'I don't pay retail. I don't pay face value. I don't care what we agreed to this is business and you take what I give to you'.
Guys like that used to have 'accidents' or they spent a lot of money on bodyguards. Seems to be a regular business mindset now. IMHO it is far too common.

One of the reasons I got out of commerical work, was getting paided.
Cover your ####, go to court and all you realy wind up with is a piece of paper that ain't worth ####.
I did a trim and casework install for a outfit a few years ago. Took me five years to get paid, but I did finally get paided the amount I was due.

This happened 10-15 years ago. And I don't remember all of the details.But IIRC he just went in with a sawzall and disaseembled it.
I took steps to reposess a fence... big one... 200' of 10' cedar fence.
In the end I decided that it was far more effective to just put the fear into her by advertising it for sale... and putting the address in the ad. I think about 50 people dropped in to have a look--not sure how many knocked on her door, but it got the point across.
Ended up taking her to court. She was nuts all right... sent in her expert witness, I chewed him up and spat him back at her. Took photos of his work (he did the front porch... enough flaws to discredit him back to the stone age).
That's the great part about representing yourself in court--you get to do the cross examination of expert witnesses up close and personal.
Should have seen him scatter out of the court room--people hung around just for this case, I had the judge giggling at one point.
In 15 years of contracting I only had to do it twice.. won both. Doesn't really matter whether you win or lose, because the cost in time is never ever worth it.
Just enjoy every day.. every experience and learn from the mistakes.

Worked for a fabrication company who did alot of work for kitchen dealers. On one job, my boss, an old Italian gentleman went over the granite tops with the homeowner. He did the templates, told them where all the seams would be., and when we would install. Did the install and the customer was happy as a clam. Now insert the kichen dealer. She tells the homeowner the seams are in the wrong place and it is a bad job. Now the homeowner wont pay the balance owed. My boss sets up a meeting with the homeowner and says he will bring his top 3 guys with him to fix any problems she may have with the tops. He tells us to get as many 5 gallon pails we can find. We show up at the house. We go in. Look at the tops. The homeowner now hates the job and wants new tops. This all because of a kitchen dealer who as we later learned, messed up the job so bad she was going to be hauled into court by the homeowner. My boss tells us to go get the buckets and bring the sledgehammers. As we go out, the homeowner gets this look of panic in her eyes. My boss pulls out a check and tells her he is going to give her her money back and we are going to take the tops away...in pieces. He grabs the small sledge and starts to swing. She screams dont. He says to her...but I thought you said it was a horrible job. She went into the next room and came back in with a check for the balance.
We were just talkin about that the other day. Yesterday, on the drive back into town. My guy says yeah once the gal who ran the shop at my last job was so bent out of shape at some customers she told him she'd give him 200 bucks to go un-install a housefull of marble counters the HO was refusing to cough up for. She knew she was going to eat it, but they sure as heck weren't going to keep the counters! So he did it.

I read a story, possibly here, about a glass block wall that was installed and never paid for, so the installer took a sledge to it and "un-installed" it. the owner took the contractor to court and judge told the owner to pound sand, cause he never paid for it.

I agree. It sounds great, I'm glad it didn't get a whole lot meaner, but I don't think I'd ever advise someone that it was the prudent thing to do.
But I love a good story, better yet if its real. Gives me someone to root for when I have to deal with someone like that.

I was gonna tell this story this morning and didnt .
I hired a hanger/taper that had been on his own and went broke. This was a number of years ago and I dont remember all the details Im sure. Anyway he worked full time for me and headed my hanging crew.
He said he did a house for some rich people and it was a damn big house. They furnished all the material which seemed odd to me . He made payroll on the hanging and finishing himself before he billed te folks. They would not pay him one red cent . This rocked on for a couple of weeks. Finally it was time for him to see his bankruptsy lawyer and file . He said the thing that steamed him the most was this couple . He went after work one day with a 4 ft crow bar and wrecked the place . He thought it was in the thousands . He just drove home and called the guy and asked for his money or he said we will be in court . That story ended there for I didnt want to know anymore . I would have liked to have known how it ended though. All I could think about was harboring a felon.

this was right after the home owner said he had no intention on paying the final bill.
I said .. fine ... I'll start taking my labor back ... U start thinking about writting that check ... let's see who wins the race.
he said ... U can't damage those materials ... I said I won't ... I'll start with two nice piles ... one pile of shingles ... one pile of nails ... than I'd add a pile of framing lumber and a bigger pile of nails.
He went inside and wrote the check!
fast forward a coupla years ... the kid is a newborn ... I sue someone for the final 10% ... and get awarded a split .. guys pays that half on the spot. I decide it's time to grow up and stop my old ways ... and let it drop.
and that's bothered me ever since! The one freaking time I go soft and it cost me money ... told Cath ... never again. Kid might have to visit Dad in jail but at least I'll be back to collecting ever cent owed me.
if people can't pay ... that's one thing .... a whole different matter ...

I think she was pimping but that's another story. I did some repairs and when I was ready to take her to court for bad check, my partner said he would cover my half to drop it. He had got the job and I jujst dropped it

She ended up in jail anyuway over something else.I did roof for a state cop and he paid me half.
Then he started doing a hundred bucks a month on the balance. The months got longer and longer, untill he finally decided that he had a leak in the roiof. It was condensation. I didn't get my final and forgot about it.
One day I got pulled over speeding a couple years later. It was him. He took one look and said, "Oh ####, it's you! Get the hell out of here."Final was for a roof I did for a professor from harvard with a place here. The chimney was falling apart - mortar gone, and the foundation needed work. I flashed to the chimney as it was 'cause he planned next year the mason.
So they jacked the house up around the chimney and repaired the foundation and never touched the chimney, then called me to fix a leak in it.The lead was all wrinkled because the house was now nearly two inches higher. I used a tube of caulk and beat it back into place and told him he still needed to have it rebuilt to keep from gassion himself. He refused to pay fifty bucks because he said his roofer in mass tiold him that it should have been a warrantee job. Then he offed me $25 to settle it. I told him all or nothing because I had earned it and he had caused it. He agreed to send the money and never did.Nowdays, every time I see him, I smile and ask if he is still screwing tradesmen out of hard earned money, usually in public. You oughta see him run when he spots me! I gaurandamntee you I have gotten my money's worth ought of him in entertainment. Every contractopr on island has his number too. He plays the game $lorn described. Always offers half.

Your story reminds me of a roofing contractor that took 5 years to pay me 500.00 for some framing.
You know how we get asked (if we don't do it) all the time for a reference of a roofer. Well, I still UN-refer this bozo. For that lengthy 500 bucks I've probably lost cost him 500,000 in lost work. And I'll continue till I croak or he goes under.

You know how after the new year is short on money? Well old boy didn't want to pay for 1000 dollar roof job. I just waited until I saw his truck sitting in Lowes, then I took my little pocketknife and cut his tires. He did not haul any material that day. BTW only do this when your riding with someone else.
The parking lot security cameras have you on tape doing that, along with the plate of the vehicle you left in. You'll probably end up buying him new tires and paying fines with the money he never paid you.
Not that I endorse people stiffing tradespeople... I'd just say get your pound of flesh while no one's looking.
I was a little wilder back then. This happened in the 80's so I'm in the clear.

The lawyer that bailed out on me the night before Ryan's hearing back in April--the one that left me nekkid in front of the judge--the one I stupidly defended when Shaggy (and others) slammed him for unlawerly behaviour--is now suing me because I won't pay him for the three hours he spent refusing to walk across the street to the courthouse to get a mandamus order to the town clowns to go get Ryan from A2BX's house when they knew where he was. If he'd done that, she'd have spent some time in the slammer and I probably wouldn't be out $10G to get him back the hard way. But he refused to do anything...for three hours straight...and is now billing me for those three hours.

When I was building I get a call from Lawyer #1's assistant saying the Town Hall has no record of me owning the land. I say "Where are you?" She says "Salisbury", I say "Wrong town, it's Southbury, not Salisbury."DOH!Later I get a bill for their getting the town wrong and wasting their time. I say I won't pay for their mistake, they say pay or we'll sue, I say go ahead.I then hire Lawyer #2 to counter-sue in the city where Lawyer #1 works. Now he's faced with being sued in front of judges he sees every day and possibly losing his license.

There are some other interesting aspects to this situation, too. Such as that he was giving a discount (a substantial one, like 35%) for cash. Hmmmm; I wonder why cash was worth so much more to him than a traceable check? Maybe I'll ask him that when I have his skinny butt in the witness box under oath....
The final straw was when he claimed he didn't remember the $500 mentioned in his retainer contract which was supposed to be held in escrow and deducted from the final bill. He then claimed he couldn't find his copy of it, so I gave him mine. He never gave it back. Now he acts like it doesn't exist.
But, if he doesn't produce the signed retainer agreement in court, he has no demonstrable promise on my part to pay him squat.
Ya can't have yer cake and eat it too, bub....
Generally, I hate going to court. But this time, I think I might actually enjoy myself some....

Sounds like this guy needs a dose of reality, maybe in the form of a formal complaint to the law review board if you're able to do that. And what do you think his reaction would be if you countersued? Your pain and suffering is obvious, not to mention Ryan's. I don't know if you have compensatory and punitive damages in Canada, but it may be something to check into, or at least throw in his face.

Well, I got the mise en demeurre (official papers) a week or so ago, and I've got 20 days to make an answer. But the entire thing is written in legal, technical French...and I don't understand legal, technical French. And my Charter Rights guarantee me that the proceedings from A to Z must be done in English if that's my choice.
So, tomorrow, I have to be at the courthouse anyway for the hearing on Ryan's custody, and I'll just get there a few minutes early and walk up to the small claims counter and say, 'Uh, I don't understand any of this. Would you please have it re-issued in English?'
As for making a complaint to the Bar against him, it's probably not worth it. This guy is not a professional a$$whole, just an incompetent jerk who seems to think he's entitled to be paid just for existing. And according to what the good lawyers I know have to say about the general run of the legal profession, if any Bar Association got rid of all the incompetent jerks on its roster, it might find itself a little short of active members....

the father ... the top dog owner ... called yesterday.
we spent about half an hour on the phone with him telling me there's no way I'd win in court ... BUT ... just to "make this all go away ....
he offered to split it.
problem was ... as I was in the middle of a work day as he was talking ... I didn't realize till later that he said he was reading an invoice from me for $642 ...
Not the $842 I had given them.
First he offered $320 ... then $400 ...
then ... after I said the smallest number that would get my attention was the $500 for the additional work me and my HVAC guy did to recess a fridge. That was an extra asked for by the HO and designer ... "if possible" ... we busted #### and made it possible ... and everyone involved that was an open and above board "extra" ...
he said ... OK, I'll send U $500, but U send me a new invoice first.
I said ... No. I'm not rewritting anything. I am owed the full amount ...
U send the $500 if U want and I'll see how I feel when I open the envelope.
So .... still not sure. Smart man would take the $500 ... still more than a split of the $862 ... and run.
me ... I'm kinda dumb and stubborn. Might just photocopy the check and send it back with a second notice for the full amount. They've really pissed me off on this one ... I'm just pissed and dumb enough to throw good money away.
Gotta decide ... is $500 weeks before XMas as good or better than $862 sometime in Feb?

I think I would meet him for the exchange with what he wants. Those are the best odds the way Im lookin at the cards. But he pays cash money for a 500 dollar final bill. I dont see any thing but in God We Trust here. Seems neither side is trusting anyway so ,.....
Theres always a good chance the judge will split as they are famous for doing . I wish they had the gonads to call it but too often they are in a political position where they were voted in . Thats the only reason Ive ever been able to figgure it. . The last guy ran a thread about a lawsuit and asked us to guess the out come . I was the dude that guessed it . Split. Theres been a few more here too that split.
All of a sudden your work is going to be unacceptable , etc. reasons . They always play their cards too . I got split in the case I described above too.
Youll lose a day for court .

he did hand scribble "as per our phone agreement" on the check receipt ... but a one sided "agrement" means nothing to me. Him making a statement isn't me making an agreement. Someone else said they'd take the $500 and lien the homeowners for the balance. Since they're trying to squeeze as much free/extra work outta the deal as possible ... that might just put the biggest smile on my face. Turn the thumb screws on all the idgits.

I got a check in a similar deal that the guy wrote final on and my lawyer told me that didnt mean squat.
I did get the rest of my money even though I cashed the check with "final" on it.
Dont know that that means sh!t in your deal but I would cash the check.

I've cashed a few cheques issued by others with whom I was having a dispute - not trades related mind you.
Each time, I wrote "Without Prejudice" on both sides of the cheque before signing and cashing it. I don't know if that would be useful in Jeff's case.

Don't forget to cross off the "Final" and take it to HIS bank and get cash. You shouldn't have to wait for your money and risk that he will put a stop payment on the check or that the bank will put a 5 or 7 day hold on your money.

You mentioned re-poing the work.
I did some work for a guy that was paying good up to a point that his gambling got him in a bit deep and he started to take some of my money for his habit.
I was to build a deck, had the material delivered and even started the work. Realized a couple days into it that he wasn't coming up with the dough(starter money). Called my lawyer and asked if I could take the pile of wood and the deck boards that were not screwed down (but were laying on the joists), with me. He said "hell no" what if the guy walks out the back door and gets hurt because I took the deck boards away! He said I'd be opening my self up to a law suit.
I left, not to happy. Never did get the money from him. Gambling, what a great habit!

Who say's the 500 is a FINAL payment... so he send's ya 500, it's a progress payment in my opinion... because he couldn't pay the entire 862...and he still owes you 362.
Take the payment, take the check to his bank, get the cash for it, then send him papers for small claims court....
then when the judge splits you get another $181, so you collected damn near 80 percent of the final bill... but don't take him to court for the measily 181 bucks, do it to spite him, that'll really put chafe his asz when he thought it was all good and paid for...
any legal begals here see anything illegal or questionable here so long as Jeff never said he would settle for $500 as the final payment? and there is no paper trail to prove such?

No sir, thats not on the table with out a final bill remember? He wanted the final bill first . Now that WAS about stupid . The guy wouldnt pay the 862 and now he wants Jeff to write one for 500 and he STILL hasnt paid him. This guys not too good a trader. Right now theres no trust on either side so Jeff has nothing at the moment thats trusted. Hes not gonna get a check either with out paper. Stalemate.

Framing in the early 70s and was told that another frame crew in the neighborhood, working for another builder that did not pay took chain saws and sawed thru key support walls, and pulled the frame with a truck. House collapsed.
I do know that a plumber who was not paid took a sledge hammer to tubs, sinks and fixtures in a new home.

We did a coffee shop commercial build out with custom cabinets and displays. We added storage shelves. We burned the midnight oil to get him up and running before the holiday season. He said he would pay us our balance after the holidays.
He never paid....but starbucks moved in a few doors down. The last time I checked he had a notice on the door where the landlord changed the locks and was not allowing entry. The landlord posted the notice on the door for all to see.
I was living in Austin in the early 80s, and apparently some guys didn't get paid for framing an apartment building. They all backed their trucks up to the building and wrapped chains around corners, etc, getting ready to pull it down. Then they called the local TV station and told them they should send someone over if they wanted to get a big story. That's how I found out. It was on the news. If I remember correctly, somebody showed up with a check, and the building didn't come down. Do any of you Texans remember that?
