I installed a new bathroom vanity top with a sink built in. I bought an extra vented metal drain pop up instead of using the plastic chrome type Kohler provides.
When I run the faucet with the drain open I have a leak.
When I fill the sink with the stopper shut I have no leaks.
The leak is coming from above the nut and seal.
I have tried having the stopper in a high position and a low position and the problem continues.
The drain pipes are straight………………….so what gives?

Is the compression washer in properly, and tight, under the sink? (I assume that's where the leak is -- you weren't very specific.)

Is the stopper lever rod nut tight? I've forgotten to tighten those sometimes and had a leak.
If the leak is at the tailpiece connection, you may need to re-make the connection. The gasket need to be firmly seated in the sink drain hole.
The water is probably getting out through the "cut-out" inlets in the side of the drain pipe that the sink overflow drains into.
You can check for this by stopping up the sink, then filling it high enough so that the water flows into the "overflow" hole on the side of the sink.
You need to get the big nut and rubber washer on the bottom of the bowl tighter, and also check to make sure that the flat area around the hole in the bottom of the sink is free of cuts, cracks, or defects. They will prevent a proper seal.
I have installed a few vanities recently and have run into the same problem on each (at least I am consistent). As suggested double check the stopper lever nut first.
That was not the problem for me, however. I couldn't get the tailpiece nut and rubber washer tightened enough to keep it from dripping around the threads. I found out by accident that if I didn't use the flat friction washer between the rubber washer and the nut I was able to get the leak to stop. I don't know if it was dumb luck, but three vanities worked out the same way, leaking with friction washer and no leak without. The last two vanities I installed, I didn't use the friction washer and had no leaks from the start.
I am sure I am doing something wrong for it to have to work this way, but it works for me.

Try a little pipe dope on the rubber washer and threads before you install them. If it's not lubricated when you install it, it might not be as tight as you think it is.

The leak is probably from the nylon ball that is on the lever rod.Put teflon tape on the threads of the pipe where the lever and ball enter under the stopper rod.Make sure you do not cross thread the nut. Easy to do because of the fine threads.

I've had this problem multiple times. I found that using 100% clear silicone on the tailpiece at the sink (instead of plumpers putty) and on the threads and the rubber works for me.
Likewise, I'm sure I'm doing something wrong, but what??????????
