I have a bathroom floor I need to tile. The home owners have removed the tile and exposed an old mud job. My question is can I tile over it (it has a few cracks in it) or can I use hardibacker or detra on top of the mud job in stead of tearing it out, sister the joists and installing plywood and hardi.

I'm not a tile setter, but I would remove it to see what's underneath. A rotary hammer and chisel bit should do the trick.

If it is smooth, you ought to be able to get away with applying an anti-fracture membrane, such as Nobleseal or DALseal (Dal Tile -- Mohawk Group), and tiling over, assuming that your thinsetting, and that you are comfortable with the substrate from a load perspective.
If this is a job for someone, you might think twice about using "old" work as your base, because any problems may become yours, but you can always have an alternate price in there that the owner can approve for the tear-out, or a hold harmless if you go over the top.
