I am in NY, and don’t know the state law about this.
Is a builder required, when offering a completed spec house built on his own property, to warranty the house part of the property package to the buyer?
Remember, it is different from being a GC and building a custom for a client on the client’s property, with the client having control over design, product selection, etc.

We are doing specs in an area where the competitors are sometimes investors who bought the land, hired a builder to throw up something, then sells the completed house package. In those cases, the sellers are not even the builders. Furthermore, in some cases, the sellers don’t get a GC to do the job, but buy the major sub packages direct . . . in effect self-contracting the work.
In the completed spec house sales I have done here, I have never met an owner, nor taken any kind of a service call for repairs or complaints. As far as I know, the owners don’t even know my name or phone contact. This is because the sales have been made by my development company.

Why would you not warranty something? Are you planning on building THAT type of home???
