I’m from Iowa, the DNR is the permitting agency for the state regarding NPDES. Here’s my question, any help would be greatly appreciated
The Code of Iowa requires compliance with the EPA’s “Stormwater” for any part of a development which was originally from one to five acres in size, and then they specifically exclude anything under 25,000 square feet.
The lot is 23,900 square feet, and originally part of a 12 acre subdivision. Do I have to comply?
I have complied up to this point, but the homebuyer wants to seed the yard (it’s almost flat anyway)and spend the sod allowance on an irrigation system. Anyway, the city contracted with a guy to interpret the enforcement, and he says I need to put silt fence back up until the seed reaches the magical 70% coverage mark. Problem is when I pull out the silt fence for em in the spring they’ll have a big mess.
He also sez I’m responsible as the builder for any runoff problems forever. This I know is bull. All I have to do is prepare a document where the buyer accepts responsibility, and they signed that with the agreement to purchase.
Anyone have any run ins with stormwater like this yet?
