I recently finished a custom spec home. Subsequently I sold it. The buyers wrote in the contract that I install “floor to ceiling bookshelves” in some alcoves next to the fireplace. When it came time to install, they told me what they really wanted was custom cabinetry, mouldings and bookshelves. I told them if that was what they originally wanted they should have written that in the contract, instead of “floor to ceiling bookshelves”. Now they are suing me. Can anyone help me, perhaps in the way of some industry standards on terminology? Any advice would be greatly appreciated… Thanks…

How much are we talking hear, $1500 bucks? What was the price of the house?
Since your asking us what that phrase means, it sounds like your not to sure yourself, or that it is open for debate. A two minute sketch added to the contract would have been worth about $60k/hour by the sounds of it.
Even without knowing the particulars I think a suit is counter productive at this point. The crux of the biscuit is that must protect your reputation to be successful in business. The buyer will aways be able to buy more houses.
I'm curious, how long have you been in business?
Tom
*Sorry, Tony, I have to agree with Tom. Apparently you allowed the homeowners to set their own expectations by not clearly defining what you were willing to do for the amount you agreed on. Even though they've let you know they are serious about this by starting litigation, it may not be too late to discuss their expectations of the job (first) - then what your expectations of the job were and see if you can come up with a solution that is acceptable to both of you. *Tony, you posted this same question last October. You got your answer then. Why are you coming back here again with the same thing? SHG
