I recently remodeled a rowhome that I am keeping as a rental. I had a window company come in and supply/install the new vinyl replacement windows. That was about 3 months ago. The new windows replaced older replacement windows that had broken panes, frames, etc.
Anyway, now that winter has arrived I am really unhappy with these windows. They leak an unacceptable amount of air for new windows. I rent the rooms in this house and one of the tenants was complaining that she was really cold in her room. I ended up having to put plastic up over the windows to block the cold air. One of the things that I noticed is that the gap between the sash and the jamb varies a lot. At its widest ( I estimate maybe 3/16″), I can easily stick the blade of my Starrret combo square through the gap. I want to go back to the vendor and get them fixed or replaced. I know that I am going to have a real fight with them on that. Especially after I had to fight them to replace a warped frame on one of the windows. I could see light coming through that gap.
I probably will end up going to court on this. I was thinking of hiring someone to do an energy audit so that I will have something to take to court. Does anyone else have any ideas of some things that I can do to prove to a judge that these windows are unacceptable?

you might be able to convince a judge...
but anyone who has any knowledge of windows knows that quality installation makes quite a bit of difference..
sounds like you got a bad installer.... who is proably also selling a substandard product
but the devil is in the details..... what is the spec and what does the contract say ?
were these old double hung ? did they have window weights ? if so.... how did they treat the weight pockets?
good replacement windows and good installation practise will usually improve perfomance over the old windows

Mike it sounds like the middle is not shimmed. There is normally a built in shim on vinyl replacement, or rather there used to be. Haven't installed any in a couple of years.

I would think it would be better to find a local carpenter with some knowledge of windows and pay to correct. Forget about a lawsuit. They are next to impossible to collect.
Sounds like the installer racked the window unit.
