Calif. Worker’s Comp

CaseyR | Posted in General Discussion on April 15, 2004 11:39am

It looks like Calif. may have a new worker’s comp program one of these days.  Not that it will necessarily get much cheaper in the near term.  From the San Jose Mercury News article:

“Workers’ compensation costs have soared in recent years in California, from $6.4 billion in claims paid in 1997 to an estimated $25 billion last year. The average cost of dealing with workplace injuries also rose dramatically, from $2.68 per $100 of payroll in 2000 to $6.30 per $100 in 2003 – the highest rate in the nation.

Most systems nationwide are more limited than the one in California, which covers all industries and all workers, including employees of small businesses. The state also makes it easier for workers to get benefits, covering injuries and occupational diseases that other states do not.”

If I remember correctly, the big jump came about because a lot of workers were claiming, and getting, disability for “stress”.  One thrust of the proposed legislation is to limit the doctors granting disability to those picked out by the insurers and the companies.  Don’t know that is entirely fair either, but certainly should cut out a lot of stress claims.  But what do I know – been under too much stress on my job…

They know the system better than most citizens. In Calif anyone can put inna claim, whether working for cash or not. If you listen to telemundo they have advertisements in Spainish telling them if theyre hurt on a job, they have a right to w/c in calif, immigration status is not a concern. go to

http://www.cis.org its the center for immigration studies and has all sorts of infor on this subj.

I knew a couple people who defrauded the system in cali on the tendonitis you get in your hands from repetitive stress, it's a common name but I can't think of what it's called.  They tried to get me to claim it.  It's completely subjective, no medical test can prove/disprove it.
