1. INTRODUCTION
Every construction project, indeed, every portion of a construction project, almost by definition carries with it numerous risks to the parties to the contract. In sum, construction projects are inherently risky – to all parties. This article deals with the types of clauses that might be used by the parties in their contracts to manage, allocate and transfer among the parties to the contract the risks involved in the construction activity. Of course, usually the parties to a contract cannot allocate or transfer risks of liability/responsibility insofar as the rights of the third parties.

sam... every once in a while we get some 'orrible examples"..
big job on the waterfront in Newport , was at the plaster stage... went up in flames just before Christmas.. just a bunch of alumapoles sticking up around the foundation..
my guess.. a million dollar loss... my agent has the account.. we'll see if everyone comes out whole
and... they may have lost some of thier rights to rebuild.. since it was an old house being remodeled.. no way could you build there today if it was virgin land.... Coastal Resources Commission would have a field day

no... that was "million dollar baby ".. that job is complete as far as i know
this one i've only seen from the bridge... but the contractor has a good rep. and the job seemed to be going well...
