I noticed you are from Texas. You need to hire a lawyer to develop a contract that is compliant with Texas Laws. Texas law clearly defines what you must disclose to your clients and the process for applying liens to a house, if needed. The lien process begins at the contract signing, not at the time of non payment. There are also accounting rules prescribed in these laws. In addition, if you are not already registered, you need to register with Texas Residential Construction Commission. This June they passed a new set of warranty requirements for residential construction work. The main features being 10 years on structural components including foundation and 2 years on almost everything else. I have identified an insurance program that satisfies the warranty requirements for each new home we build and they are currently developing one for residential remodel.
