Id re route the gutter to run on the roof above the tree. Couple elbows, 16p nails, some caulk...no problem

Well, sorry everyone else here missed the point of your thread. I can clearly see the actual problem here.
There are two things wrong, actually.
1. For the person in the picture to actually flash, they need to expose alot more flesh than they are showing now.
2. To flash the roof, they need to be outside the house, not inside.
