It should be the buyers who carry that burden, not the defrauded owners. The buyer should have to do a title search, and all the rest of the rigamarole that we do in the US.
However, there should also be a program like that, "Ontario's Land Titles Assurance Fund", which they CAN make use of to regain some of their money if they too were the victim of fraud.
As it is, it should be the buyers in the cases highlighted in this news story that should be making use of that beaurocracy...

I actually read this thread earliar but as Luka stated it wouldnt pass a title search here . After that its a little foggy since Im not a lawyer , but I know it would make the defrauding people felons. We have theft by recieveing here which might not connect to this but Im prety sure the new owners would lose the house and have their recourse with the sellers. The real losers here would be the buyers.

It will show that HO signed a notrized POA and the POA holder signed to deed.A title company is not going to track down each party and get handwritting specialist to verify signatures.What they look for is liens and to see that names match. For example if was show as sold the Husband and Wife, but only on name on the next sale they would question it.But they don't question signatures unless there is a specific reason to.Article in the local papers a few months ago about similar problems in the Kansas City area.They usually look for homes that are rental and/or vacant and with elderly owners. Because of that it often the fraud is often not know for a while.The big difference is the that the orginal owners have the weight of law behind them, as you have pointed up. But they still often need the lawyers to get things straightened out.So the losses would be on the buyers and mortgage companies.
Because they arent the owners on record . It could happen as you say.
All believed on a false form . Even if it went through the buyer would not be protected. As you agreed . No sale even if it happened .
Be a law suit .

That is all the more reason for a national picture ID with a finger print. The iris of your eye recognition would be good also. When I was in Finland in 1986 all credit cards had a picture on them. Yet, in the US we have few which do.
