what do you guys think about a roofer who puts in his contract “install ice and water barrier”, then strips the roof and finds ice and water barrier (full of holes of course), then claims the old stuff is all thats needed.
then he goes ahead and roofs over that

Are you saying that he laid shingles directly over the old ice and water shield? How much was laid, two courses? Did he install new tarpaper?I suspect that he's a hack but I need more details.

What do I think?I can see places where I would be very comfortable leaving the old and just going over with RGT II, but not when I put it in a contract.For instance in a well vented attic scenario and a steep roof, if I were the client, I would accept it and deduct cost of the I&W and labour to install.But otherwise, he would not see a dime until he did the job the contract called for.

I said basically the same thing, the back side is a straight go with a steep pitch. thats where he was working when I showed up. the rest of the house which is done already is way too cut up for any slip shod work.

Contract says "install" and he never installed. 'Nuff said.
Problem is while the membrane seals around nails, those nails are now gone. If the house stands any chance of ice dams, or if there is a history, I'd be really ticked and demand a mulligan.
If there is good insulation/venting and there has never been an accumulation or damming, then you could consider taking a material and labor credit instead.
Was this your lowest bidder? After many years as an institutional buyer I learned to apply TCO (Total Cost of Ownership) to our buying. Cheaper going in isn't always cheaper in the long run. The lowest bidder didn't always get the job.

the roofer gave the HO another bs story about how he likes the older stuff better because it is thicker and he said he left all the nails in it
of course thats a lie. I know because I climbed his ladder and had a look at it. it was full of holes
realizing he was backed into a corner he agreed to give the HO a written 10 year warrantee
it was good enough for the HO.
