My brother who lives in Houston, had a tree in his yard fall on his truck which is uninsured. Will homeowners cover the truck? Any insurance people out there? Thanks.
More info… He was at his girl friends house and a neighbors tree hit his truck. Is the neighbor or the neighbors ins. co. responsible?

Depends on the policy I think, on Mother's Day the wife's car got creamed by a big branch, took out the rear glass.
Auto ins only covers glass with comprehensive coverage, HO policy is for House and contents and liability if someone gets hurt here or my dogs attack. I don't think an auto is allowed on a HO policy unless maybe it was garaged INSIDE the home and was somehow considered a "content". Such as a collectible vehicle with a specific rider on the policy named as such.

Typical HO's insurance does not cover items in the home that are normally insured othrwise. That would include a car and boat with a motor. but a canoe would be covered.I had a small fire in the garage and my van was in it. The insurance co would not pay for cleaning it up.However, he is a little different position.The damaged was caused by a tree from a 3rd party. So the question is if tht 3rd party is liable or not. Doesn't matter what kind of insurance that they have (all though it might affect the ability to collect).The general rule is that if the tree is has a none defect, such as it was dead or it was already leaning 30 degrees, then the HO is liable for any damage that it does. Other wise that it is an act of God and they aren't liable.Now the problem has to been known to the HO. For example if the tree was rotten on the inside, but did not show any problem then they are responsible..

I have been in the Insurance claims industry for 29 years. Your brother is out of luck. Homeowners policies actually have an exclusion for owned vehicles.

I don't have any knowledge/experience in this stuff but my logic sensors are telling me that if my neighbors tree falls on my truck that they should be responsible - again, I have no experience with this just seams like the logical way?

Nope! My tree falls on your house? Your insurance picks up the tab.
If your tree is a known hazard (dead, split, etc) and it damages other property then YOU are liable. And if you have HO liability insurance they would pay.Otherwise it would be an act of God. And if the vechicle owner has inusrance (I think comprehensive and not collision, but not sure) then that insurance would pay..

Who said liability had anything to do with logic? Even if an old, rotten tree falls after the neighbor has been warned to take it down, it's considered an "act of God" in many states and the neighbor is not liable.

I have a really nice, really big, pin oak in my back yard, its about as healthy a tree as I've ever seen. My neighbor lady, who hasnt found anything or anybody yet that she cant find something to complain about, always tells me that she worries about that pin oak cause if it were to fall in a big storm that it would land on their house. I always tell her thats what I have insurance for.
Now when she says it I'm going to tell her, thats what YOU have insurance for. That should make her day!

My healthy looking tree fell down in a violent thunderstorm a few years ago. Landed on the neighbor's garage. I didn't have to do a thing. The neighbor's insurance paid for cutting it up and hauling it away and fixing their garage. I didn't even have to sign a piece of paper or anything.
