If a roofing contractor uses a nail gun to install 125 square roof and he blows the nails thru the shingles. Does his liability insurance cover the cost of reroofing the house or do we go directly to the roofer?
Thanks

If his liability ins covers stupidity he's covered.
Another illegal alien roof crew?

You deal with the contractor. once there is a case against him, he can either replace the roof for you out of his pocket, or he can file a claim with his insurance company. They do not have any relationship with you. Their relationship is with him.
my opinion is that a typiccal contractor's ;liability policy will not cover this. They might cover things is his negligence in promptly resolviong things caused you to experience leaks and damage to belongings.

I agree. Liability insurance is not a warranty. It sounds like he ruined the shingles he supplied, and his insurer will not replace them. If, however, the roof leaked and damaged your grand piano, then the insurer would deal with the piano.
In Texas, any damage done by a contractor will be covered ....sorta.....
The items damaged will be paid for...LESS depreciation.
I had a roofing company who's work caused a leak through the ceiling. Light carpet was damaged due to big, colorful, but unremoveable stains, even with the work of a professional carpet cleaner. The rep. from the roofing company said "Order new carpeting. We'll pay for it."
When it came time to pay up...he quoted the state law and the old carpet's 8 years of depreciation which about half the total cost... Luckly, I had contacted my homeowner's insurance agent as I was getting growing bad feelings about this company. Back then, I had only a homeowner's policy with a $50.00 deductible...They then had to settle it with the roofing company and after walking on wooden floors and tack boards, finally we got the new carpet installed. Whew!!
By the way, this company, based in Grandbury, Tx. had our Mahogany dining table refinished, too. However, can you believe that the company rep. picked it up from the refinisher, had it stored in his garage, and was holding it hostage? He said he would release it when I signed a release.... I told him that I'd turned it over to my State Farm Agent and couldn't sign any type of release. NO RELEASE>>NO DINING TABLE. It was the day before Thanksgiving, so my insurance company's rep. called him and I got our table back at 7:00 p.m. the night before Thanksgiving.
Maybe your homeowner's policy can give you some added clout...
