I recently completed a job that had a 9 month time frame specified in the contract(subject to weather, acts of God, etc.) The job went almost a month over. There was no penalty for exceeding the time frame spelled out.
I won’t go into all the details, but significant delays were caused by subs that they requested. I foolishly agreed to use these subs- the electrician, HVAC, painter, and carpet installer.
We’re settling up and the guy whips out his bank loan statement and wants me to do additional work totaling his last month’s interest amount. In the interest of good customer relations I am willing to compromise, and do something for him. He is taking a hard line and telling I owe this to him, and that my explanations for the extra time are nothing but excuses.
My question: If there is no penalty spelled out in the contract am I legaly required to pay one in the form of cash or services?
